What is a “statutory nuisance” from insects?
From 6 April 2006, the Clean Neighbourhoods and Environment Act 2005 added to the descriptions of statutory nuisance listed in section 79(1) of the Environmental Protection Act 1990 (EPA 1990) to include: “Section 79 (1)(fa) any insects emanating from relevant industrial, trade or business premises and being prejudicial to health or a nuisance.”
This doesn't apply to insects from domestic premises, which can be dealt with under existing nuisance law.
Examples of likely sources of insect nuisance complaints include:
- Sewage treatment works
- Manure and silage storage areas
- Stagnant ditches and drains
- Landfill sites
- Refuse tips
- Waste transfer premises
