Part 3 of the Environmental Protection Act 1990 requires us to
take reasonable steps to investigate and, if appropriate, to take
formal action to in the event of justified complaints of statutory
nuisance.
Statutory nuisance includes filthy and verminous premises,
smoke and ash from garden bonfires, smoking chimneys, light
pollution, dust from building and demolition activity. The
legislation does not allow us to deal with complaints of smells
arising from domestic premises.
The Environment Unit regularly gets involved in resolving
nuisance problems. In most instances this is achieved
through informal advice. Where people are reluctant or
unwilling to take steps to stop causing the problem then formal
action can be taken. An Abatement Notice will be served upon the
person responsible for the nuisance, or the owner/occupier of
the premises (as appropriate) requiring that they stop causing the
nuisance. Failure to comply with an abatement notice is an offence
and legal proceedings may result.
