Councillors Code of Conduct - Localism Act 2011

The Localism Act 2011 places a duty on local authorities to promote and maintain high standards of conduct by their Elected and co-opted Members.

The Standards Board for England was abolished on 31st March 2012 together with its regulatory role in handling cases. As from 1st July 2012 the new standards arrangements, which includes a Code of Conduct, the involvement of in an Independent Person in allegations of misconduct, and a new criminal offence of failing to declare or register interests came into force.

The powers of the local authority in relation to allegations are for local determination, following advice from the authority’s Monitoring Officer or legal team. These powers might include censure or the removal of a member from a committee, but the authority cannot disqualify or suspend members as this power was revoked (from 7 June 2012) by the Localism Act 2011 (Commencement No. 6 and Transitional, Savings and Transitory Provisions) Order 2012.
